


General Terms and Conditions of Sale (GTCS)



- Article 1 – Purpose and Scope
These General Terms and Conditions of Sale (GTCS) govern the sale of products offered by Atelier tar.tea.ne, a sole proprietorship (auto-entrepreneur) registered in France, through the website www.tarteane.com.
The products offered for sale include:
physical products, notably handmade tufted rugs;
digital products, notably downloadable cross stitch patterns.
These GTCS apply to all orders placed on the website by consumers (B2C) acting for personal, non-professional purposes.
Any order placed on the website implies full and unconditional acceptance of these GTCS by the customer.
Physical products are shipped internationally, with the exception of the European Union (not including France), USA, Emirats Arabes Unis, Qatar, Iran, Irak, Bahreïn, Sri Lanka, Koweït, Afghanistan, Azerbaïdjan, Ouzbékistan, Kazakhstan, Kirghizstan, Tadjikistan, Turkménistan and Bhoutan, which are not served for these items.
Digital products are available for purchase worldwide, including in the United States.
Atelier tar.tea.ne reserves the right to modify these GTCS at any time. The applicable GTCS are those in force at the date of the order.
- Article 2 – Prices and Payment
2.1 Prices
Prices are indicated in euros (€) and are those applicable at the time of the order.
As Atelier tar.tea.ne operates under the French auto-entrepreneur regime, VAT is not applicable in accordance with Article 293B of the French General Tax Code, unless otherwise stated.
Atelier tar.tea.ne reserves the right to modify its prices at any time. However, products will be invoiced based on the prices in effect at the time the order is placed.
For physical products, shipping costs are not included in the product price and will be specified before order validation.
2.2 Payment Terms
Payment is due in full at the time of ordering.
Payments are processed securely via Stripe using credit card. The customer guarantees that they are fully authorized to use the payment method provided.
Atelier tar.tea.ne reserves the right to suspend or cancel any order in the event of payment authorization refusal or non-payment.
- Article 3 – Order Process
The customer places an order on the website www.tarteane.com by selecting the desired products and following the checkout process.
Before confirming the order, the customer has the opportunity to review the details of the order, including selected products and total price, and to correct any errors.
The order is considered final once the customer has completed the payment process.
After the order is placed, the customer will receive a confirmation email summarizing the order details.
For digital products, access to the downloadable files is provided immediately after payment confirmation, either via the website and/or through the confirmation email.
Atelier tar.tea.ne reserves the right to refuse or cancel any order in the event of a dispute with the customer, suspected fraud, or any other legitimate reason.
- Article 4 – Delivery
4.1 Delivery of Physical Products
Physical products are made to order. The preparation time is estimated at 2 to 3 weeks, to which must be added the shipping time.
Orders are shipped via La Poste (Colissimo or Delivengo) with tracking.
Delivery times are provided as an estimate and may vary depending on the destination and external factors. Atelier tar.tea.ne cannot be held responsible for delays attributable to the carrier or events beyond its control.
The customer is responsible for providing accurate shipping information. In the event of an error in the delivery address, Atelier tar.tea.ne cannot be held responsible for failed or delayed delivery.
In case of loss or damage during transport, the customer must contact Atelier tar.tea.ne as soon as possible. A claim may be opened with the carrier. Depending on the situation, a replacement or refund may be considered.
4.2 Delivery of Digital Products
Digital products are made available immediately after payment confirmation.
The customer receives access to the files via the website and/or through the order confirmation email.
4.3 Customs and Import Duties
For international orders, the customer may be subject to customs duties, taxes, or import fees imposed by the destination country. These charges are the sole responsibility of the customer.
- Article 5 – Right of Withdrawal and Returns
5.1 Right of Withdrawal for Physical Products
In accordance with applicable consumer laws, the customer has a period of fourteen (14) days from the date of delivery to exercise their right of withdrawal, without having to provide any reason.
To be eligible for a return, items must be:

unused;
-
in their original condition;
-
not damaged, altered, or worn.
The customer must contact Atelier tar.tea.ne before returning any product.
Return shipping costs are the responsibility of the customer. The original shipping costs are non-refundable.
Once the returned product has been received and inspected, a refund will be issued using the original payment method, within a reasonable timeframe.
5.2 Exclusion of Right of Withdrawal for Digital Products
In accordance with applicable law, the right of withdrawal does not apply to digital products once the download has begun.
By purchasing a digital product and accessing the files immediately after payment, the customer expressly agrees to waive their right of withdrawal.
Therefore, digital products are non-refundable and non-exchangeable.
5.3 Delivery Issues and Claims
Delivery is considered completed when the product is marked as delivered by the carrier’s tracking system.
This status constitutes prima facie evidence of delivery.
In case of any issue (missing, damaged, or incorrect package), the customer must contact Atelier tar.tea.ne within a reasonable timeframe after the indicated delivery date.
Atelier tar.tea.ne reserves the right to request supporting documents and to open an investigation with the carrier before offering any resolution.
- Article 6 – Liability and Warranty
Atelier tar.tea.ne undertakes to provide products that conform to the descriptions presented on the website.
Due to the handmade nature of the physical products, each item is unique. As such, slight variations in color, shape, size, or finish may occur compared to the photos displayed on the website. These variations do not constitute defects and cannot give rise to claims, refunds, or liability.
Atelier tar.tea.ne shall not be held liable for any indirect, incidental, or consequential damages resulting from the purchase or use of its products.
For physical products, Atelier tar.tea.ne cannot be held responsible for damage resulting from improper use, handling, or maintenance by the customer.
Regarding digital products, Atelier tar.tea.ne shall not be held liable for any issues related to compatibility with the customer’s equipment, software, or technical environment.
In any event, the liability of Atelier tar.tea.ne shall be limited to the amount paid by the customer for the order.
- Article 7 – Intellectual Property
All content on the website www.tarteane.com, including but not limited to digital cross stitch patterns, product images, texts, logos, and designs, is the exclusive property of Atelier tar.tea.ne and is protected by applicable intellectual property laws.
7.1 Use of Digital Patterns
By purchasing a digital pattern, the customer is granted a personal, non-exclusive, non-transferable license to use the pattern for personal purposes only.
The customer may:

create finished products from the pattern for personal use;

gift the finished products to others;

share images of the finished products on social media.
The customer may not:

sell, resell, or commercially exploit the digital pattern or finished products;

distribute, share, or make the pattern file publicly available in any form.
7.2 Enforcement
Any unauthorized use, reproduction, or distribution of the digital patterns or other intellectual property constitutes a violation of copyright law and may result in legal action.
- Article 8 – Privacy and Data Protection
Atelier tar.tea.ne is committed to protecting the personal data of its customers in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).
8.1 Collection and Use of Personal Data
Personal data collected may include:

Name, email address, billing and shipping information, for the purpose of processing orders;

Email addresses for sending newsletters or promotional communications.
Personal data is used only for the purposes for which it was collected and will not be shared with unauthorized third parties.

These General Terms and Conditions constitute the entire agreement between the parties regarding the sale of products on the website and supersede all prior agreements, communications, or understandings.
